The general conditions of sale presented here govern the contractual relationship between Maité Léon, artist-author (Siret n° 902 930 858 00011 • Code APE 9003A) and any customer using the online shop selling art prints accessible at address www.maiteleon.com. They are applicable to any purchase made on the site shop.
The customer acknowledges having read the general conditions of sale and accepts them without reservation when concluding a contract with Maité Léon. The latter reserves the right to modify the content at any time. The General Conditions applicable to an online print sale will be those in force at the time of payment of the price of this sale.
2 • Nature of art prints sold
An original art print is an edition made by the artist, printed by him or under his control, signed and numbered within the limit of thirty copies, all formats and media combined (art.98A Appendix III of the French CGI).
As this definition stipulates, each print is numbered and signed by me. The number of possible prints for a work is determined at the start. It can vary from 1 to 30 maximum. This element is notified for each of the images offered on www.maiteleon.com. The buyer is sure to be the sole owner of the print bearing the number that appears on the front and back.
As the quantities available are reduced, the price of the prints may vary, even for an identical format and finish, depending on the total number of prints in the series (from 1 to 30) or the number of prints remaining possible. Prices are available for each image on the product page.
3 • Registration procedure
To benefit from the services offered on the website www.maiteleon.com, an online registration is necessary. The future user will then be asked for mandatory and optional information. He must, among other things, provide his surname, first name, postal address and email address. The user will then have to choose an identifier and a password in order to be able to connect to his session.
As stipulated in the Privacy Policy, this data will only be used to process the order and will never be transmitted to third parties.
4 • Order
Once registered, the user can place an order on the site www.maiteleon.com.
The validation of an order implies the total acceptance of the General Conditions of Sale.
The following means of payment are available via the website: Bank card and PayPal®.
If a customer wishes to pay by bank transfer, they will need to write to us at shop@maiteleon.com to finalize the order and payment.
The buyer is invited to check the personal data (emails and postal address) that he provides, as they are used to process the order and to ship the art print. Any error, due to an erroneous address, will result in new shipping costs being borne by the buyer.
The prices indicated for each art print depend on the size and finish desired, they do not include shipping costs. Their amount will be calculated when the order is finalized.
An invoice will be established by the author and sent to the email address indicated at the time of the order.
5 • Delivery deadlines
With some exceptions, the prints ordered are not in stock. The available quantity indicated on the product page corresponds to the number of prints still available in the series.
The order therefore involves sending the file to a laboratory specialized in fine art prints, then a verification of the print by the Author who must sign and number it. Following this, the package will be taken care of by the Post Office or a specialized distributor (examples: UPS – DHL). A period of fifteen days to three weeks is therefore possible between placing the order and receiving the art print.
A tracking number will be sent to the buyer by email as soon as the shipment has been made.
The delivery time depends on the carrier, a possible delay cannot be the subject of a claim or a complaint, no compensation can be requested from Maité Léon.
If for exceptional reasons the order processing time should be longer, the buyer will be informed by email.
6 • Receipt of the package
To guarantee you an optimal quality of the art prints, these are wrapped in tissue paper to avoid scratches, then in a plastic film to prevent humidity. Subsequently, the prints are placed either flat in a reinforced box or in a triangular cardboard tube, depending on the size of the prints.
If your package is damaged during delivery (bent box, crushed tube), you must refuse it for it to be returned to us.
Fine art edition prints are works to be handled with care, special attention should be paid when unpacking the package. Negligence causing deterioration of the print would be the sole responsibility of the customer.
To ensure that you retain all the qualities of the print, it is strongly recommended that you handle it with cotton gloves so as not to alter the surface or leave fingerprints on it.
7 • Withdrawal period
We invite you to choose your art print carefully, as the right of withdrawal will not apply. For any prior questions write to us at shop@maiteleon.com.
8 • Intellectual property
The numbered and signed prints sold on the www.maiteleon.com site are protected by the French Intellectual Property Code.
The Buyer is informed that under Article L111-3 of the French Intellectual Property Code, the acquisition of an art print does not confer any intellectual property rights on the work. Any reproduction or distribution is prohibited without the prior consent of the Author. Any use that does not comply with the legal provisions constitutes counterfeiting and may lead to prosecution on the basis of articles L122-4 and L335-2 of the French Intellectual Property Code.
9 • Applicable law and competent jurisdiction
These general conditions of sale as well as the contractual relationship between the Buyer and the Author are subject to French law.
In the event of a dispute, and in accordance with the provisions of the Consumer Code, the buyer has the right to call on a mediation service.
In accordance with article L 152-2 of the French Consumer Code, for a dispute to be examined by an external body, the buyer must be able to justify that he has tried to resolve his dispute beforehand directly with Maité Léon. This dispute may be brought to the attention of Maité Léon by email or post.
